Terms of Service

These Terms of Service ("Terms") are an agreement between you and Apparent Group Limited ("we", "us", "our") governing your use of the WellFast mobile application and any related services (together, the "App"). By creating an account, subscribing, or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.

WellFast is a general wellness product focused on intermittent fasting, health check-ins, educational content, community features, and optional AI guidance. It is not a medical device and does not provide medical diagnosis, treatment, or advice.

1. Acceptance of Terms

By accessing or using the App you accept these Terms and our Privacy Policy, which is incorporated here by reference.

If you use the App on behalf of another person or an organisation, you confirm you are authorised to accept these Terms for them.

2. Eligibility

You must be at least 16 years old, or the minimum age of digital consent in your country if that is higher, to create an account.

The App is not intended for children. If you believe a child has created an account, contact us and we will remove it.

3. Health Disclaimer

The App provides general wellness and educational information only. It is not medical advice, and no doctor–patient relationship is created by using it.

Fasting is not appropriate for everyone. Consult a qualified healthcare professional before starting any fasting protocol, and do not begin, stop, or change any treatment based on content in the App.

• Do not use fasting features without medical supervision if you are pregnant, breastfeeding, or trying to conceive.
• Seek medical advice first if you have diabetes, low blood pressure, a history of disordered eating, or any chronic condition, or if you take prescription medication.
• Stop fasting and seek medical attention if you feel faint, disoriented, or unwell.
• Programs, plans, reminders, and AI responses are suggestions generated from the information you provide — they are not personalised medical guidance and may be incomplete or inaccurate.
• In an emergency, contact your local emergency services. The App is not a substitute for emergency care.

4. Your Account

You are responsible for the accuracy of the information on your account and for keeping your credentials secure.

You are responsible for activity that happens under your account. Tell us promptly if you believe it has been used without your permission.

5. Subscriptions, Billing and Cancellation

Some features require a paid subscription. Subscriptions are sold and processed by the Apple App Store or Google Play, not directly by us.

The price, billing period, and any free-trial length are shown to you in the App before you confirm the purchase, in your local currency. Those displayed terms govern your purchase.

• Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
• Your payment method is charged through your Apple or Google account at confirmation of purchase and on each renewal.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• Cancel at any time in your Apple App Store or Google Play subscription settings. Cancelling stops future renewals; it does not shorten the period you have already paid for.
• Uninstalling the App does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies. We cannot issue refunds for store purchases directly.
• Promotional or discounted offers apply only to the period stated in the offer; the subscription renews at the standard price after that period unless you cancel.
• We may change prices. A price change applies from your next billing period after we notify you, and you can cancel before it takes effect.

6. Acceptable Use

You agree to use the App lawfully and not to misuse it or interfere with others’ use of it.

• Do not attempt to access accounts, data, or systems you are not authorised to access.
• Do not reverse engineer, decompile, scrape, or attempt to extract source code or data from the App, except where that restriction is prohibited by law.
• Do not upload malware, attempt to disrupt the service, or circumvent security, rate limits, or payment controls.
• Do not use the App to provide medical advice to others or to present its content as professional advice.
• Do not resell, sublicense, or commercially exploit the App or its content without our written permission.

7. Community Content

The App includes community features where you can publish posts, comments, and images. You remain responsible for what you publish.

You keep ownership of the content you post. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating the App.

• Do not post content that is unlawful, hateful, harassing, sexually explicit, or that targets or discloses information about another person.
• Do not post medical claims presented as professional advice, or promote unsafe fasting practices.
• Do not post spam, advertising, or content that infringes someone else’s intellectual property or privacy.
• We may remove content or suspend accounts that breach these Terms, and you can report content from within the App.

8. AI Features

The App may offer AI-generated responses. AI output can be wrong, incomplete, or out of date, and must not be relied on as medical, legal, or financial advice.

Do not submit sensitive information you would not want processed by an automated system. Use of AI features may be subject to fair-use limits.

9. Intellectual Property

The App, its content, design, and trade marks are owned by Apparent Group Limited or its licensors and are protected by intellectual property laws.

We grant you a personal, limited, non-transferable, revocable licence to use the App for your own non-commercial use, subject to these Terms.

10. Third-Party Services

The App relies on third-party services — including app stores, payment and subscription infrastructure, cloud hosting, analytics, and AI providers — and may link to third-party content.

Those services operate under their own terms and privacy policies. We are not responsible for third-party content or practices.

11. Termination

• You may stop using the App at any time and can delete your account from within the App.
• We may suspend or terminate access if you breach these Terms, if required by law, or if continuing to provide the service is no longer reasonable.
• Deleting your account does not automatically cancel a subscription bought through a store — cancel that separately in your store settings.

12. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind to the extent permitted by law.

We do not warrant that the App will be uninterrupted, error-free, or that content, reminders, or notifications will always be delivered on time or at all.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising from your use of the App.

Where liability cannot be excluded, our total liability is limited to the amount you paid us for the App in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or your statutory consumer rights.

14. Indemnity

You agree to indemnify us against claims, losses, and reasonable costs arising from your breach of these Terms, your misuse of the App, or content you publish through it.

15. Changes to These Terms

We may update these Terms as the App changes or as the law requires. When we do, we will update the effective date above and, where the change is significant, notify you in the App.

Continuing to use the App after an update means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules, and the Hong Kong courts have non-exclusive jurisdiction.

If you are a consumer, you keep the benefit of any mandatory protections of the law of your country of residence.
